About Approved Potentials

Approved Potentials is a qualification and employment platform designed for international professionals seeking to work in Germany. It is operated by VON DONAU GmbH (Philippstraße 27, 52349 Düren, Germany). Throughout these Terms and Conditions, the operating company is referred to as Approved Potentials. The platform specializes in connecting foreign professionals with German employers, providing tailored services for qualification validation and targeted placement. Approved Potentials offers applicants clear and structured processes to maximize their career opportunities in the German job market.

 

  1. Target Audience and Scope of Application

Scope of Application
These Terms and Conditions (T&Cs) apply to all foreign professionals who use the services of Approved Potentials and are not German citizens. The platform is intended for:

  • International professionals, including individuals from other European countries (outside Germany), who seek a career in Germany.
  • Professionals who wish to work remotely for German employers from their current country.
  • Foreign nationals residing in Germany who wish to validate their qualifications or utilize employment services.

Participation Requirements
A minimum age of 18 is required to use the platform. Applicants must explicitly agree to these T&Cs to use the services of Approved Potentials; otherwise, participation is not allowed. We kindly ask users who do not accept these terms to refrain from using the platform.

Geographical Scope and Jurisdiction
The Approved Potentials platform is available to foreign professionals worldwide, subject to these T&Cs. The legal basis of the T&Cs is German law, and the agreed jurisdiction is Cologne, Germany. Any disputes arising in connection with the use of our platform are subject to German law.

 

  1. Definition of Services

Approved Potentials offers two essential services for international professionals seeking a career in Germany or remote work for German companies:

  • Qualification Validation: This service includes the verification and assessment of the applicant’s professional qualifications and experience according to Approved Potentials’ criteria. Validation is based on information and documents provided by the applicant and is completed within 24 hours, resulting in classification into one of four categories:
    • Highly employable,
    • Good employability,
    • Average employability,
    • Not employable.

Validation Note: The assessment is based solely on Approved Potentials’ criteria, founded on years of experience and analysis. It serves as guidance on employability prospects in the German job market and is not transferable to other placement agencies. The validation is not a personal evaluation and should not be seen as a judgment of the applicant’s personality.

Employment-Focused Approach: The Approved Potentials platform is designed to generate efficient and successful placements in the German job market. Those uncomfortable with the rating or validation should refrain from participating in the validation.

  • Placement Service: Applicants deemed employable after the qualification validation can initiate a placement request. Through this service, the applicant’s profile is anonymized and selectively shared with potential employers in Germany. The placement service is monthly, and applicants can flexibly manage and terminate the service as needed.

 

  1. Fees and Payment Terms

Approved Potentials services are subject to fees. The applicable conditions and fees for each service are transparently displayed during the booking process.

Fee Structure
The fee structure includes qualification validation and the monthly fee for the placement service. Details are provided on our website under “Terms & Fees.” These fees are clearly presented before booking to provide applicants with a full understanding of the costs.

Payment Terms
Payment of applicable fees is required to access the chosen services. Payments can be made using available payment methods, which may vary depending on the user’s location. If payment for the monthly placement service is not made at the beginning of the month, the placement request is automatically paused, and the profile is no longer visible to German employers.

No Refunds
Fees paid for validation and placement services are non-refundable, as services begin immediately after payment is received.

 

  1. Data Protection

Protecting personal data is a top priority for Approved Potentials. Data processing and storage comply with the General Data Protection Regulation (GDPR) and applicable German data protection laws.

Data Collection and Use
Only the data necessary to carry out the qualification validation and placement services are collected during service usage. This includes contact and profile details and all relevant information for validation and placement.

Anonymization and Data Sharing
Your profile is anonymized when shared with potential employers. Personal data is only shared with explicit consent and only when necessary for placement. No data is shared with third parties without your permission.

Data Security
All personal data is protected by technical and organizational measures against unauthorized access, loss, or misuse. Only authorized staff members can access data to the extent necessary.

Data Deletion
After ending the service and account deactivation, we store your data for six months to facilitate possible return. After this period, your data is permanently deleted.

Your Rights

  1. Limitation of Liability

Service Availability and Disclaimer
Approved Potentials aims to provide a reliable service with high availability. However, services and content are offered without warranty or implicit or explicit guarantees. In particular:

  • Availability: Continuous access to our servers or uninterrupted use of our services is not guaranteed. Access may be limited due to maintenance, capacity issues, or unforeseen events beyond our control.

Disclaimer of Damages
Approved Potentials is not liable for damages related to platform use or technical issues, including damages from access interruptions or technical issues.

  1. Contract Duration and Termination

Minimum Duration and Renewal of Placement Request
The placement request via Approved Potentials is concluded with a minimum monthly duration and renews automatically each month unless the applicant terminates it by the end of the month. Applicants maintain flexible control over the service’s use according to their needs.

One-Time Validation
Qualification validation is a one-time service, not subject to a contract term, provided immediately after payment and non-cancelable.

Termination of Placement Request
The applicant can terminate the placement request at any time by the end of the month. Termination can be made via the platform’s user account or by notifying support in writing.

Termination of Platform Registration
Registration on the platform can be terminated by the applicant at any time. Upon account deactivation, access to Approved Potentials services is revoked.

 

  1. Responsibility of Applicants for Their Content

Successful qualification validation and placement require applicants to participate responsibly. Applicants agree to follow these guidelines when entering data and uploading content:

  • Responsibility for Uploaded Content and Documents: Applicants are solely responsible for the accuracy and authenticity of uploaded documents and content. Approved Potentials relies on provided documents being originals or authorized copies.

Approved Potentials reserves the right to exclude applicants who violate these guidelines from the platform without prior notice.

 

  1. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Federal Republic of Germany. For any disputes related to the use of Approved Potentials, the jurisdiction is Cologne, Germany.

 

  1. Final Provisions

Amendments to T&Cs
Approved Potentials reserves the right to modify these Terms and Conditions at any time. Users will be informed of changes by email.

Severability Clause
If any provision of these T&Cs is found to be invalid, the validity of the remaining provisions shall remain unaffected.
